The Calixto Agreement is a September 22, 2022 settlement in which the U.S. Army agreed to certify Form N-426 for certain enlistees from the MAVNI program, which can make them eligible to apply for naturalization under INA 329. It covers only people who enlisted through MAVNI on or before September 30, 2017. This guide uses the current USCIS Policy Manual, checked on October 21, 2026. Who is a Calixto class member?
A Calixto class member is someone who enlisted in the U.S. Army through the MAVNI program on or before September 30, 2017, including the Selected Reserve Delayed Training Program or the Regular Army Delayed Entry Program, and who either was not discharged as of September 22, 2022 or had received an uncharacterized discharge by that date.

What did the Calixto Agreement change?
The Army agreed to certify Form N-426 for class members, even some who never began a qualifying period of service or attended initial entry training. By certifying the form, the Army certifies honorable service, so class members with a certified N-426 can become eligible to apply under INA 329.

What should a Calixto filing include?
A Form N-400 and a Form N-426 certified by a person the Army authorizes. USCIS says you may also include a copy of the September 22, 2022 agreement in place of listing the type and length of service, and that writing "Calixto" at the top of the N-400 and N-426 helps USCIS process the case.
- Get a certified Form N-426 from the Army (USCIS Policy Manual).
- Complete Form N-400 under INA 329 (USCIS Policy Manual).
- Optionally attach a copy of the Calixto Agreement as evidence of honorable service (USCIS Policy Manual).
- Write "Calixto" at the top of Form N-426, and at the top of Form N-400 if you file on paper. Online filers mark only the N-426 (USCIS Policy Manual).
Is USCIS's 2022 Calixto announcement still current?
USCIS has archived its 2022 announcement and marks it as out of date, though it says some content may still help. The current guidance is in the USCIS Policy Manual, Volume 12, Part I, Chapter 3, which still describes the Calixto Agreement and the filing steps above as of October 21, 2026.

Does the Calixto Agreement apply to new Guard enlistees?
No. It covers only MAVNI enlistees from on or before September 30, 2017. A green card holder joining the National Guard today follows the standard INA 329 rules: honorable service during the designated period, a certified Form N-426 while serving, and English, civics and good moral character. Confirm your eligibility with a recruiter and USCIS.
